A client (an advertising agency) wanted to use a portion of a Christmas film in an advertisement it was creating. While the film was in the public domain, the book on which the film was based was still under copyright. We offered to identify the portions of the movie that did not relate back to the underlying work, and thus, remained in the public domain. Ultimately, the client pivoted to a different marketing strategy altogether, but now understands that there may be a path forward if it decides to pick the idea up again. Helping clients in creative industries understand the risks and suggesting alternatives often enhances the creative process while protecting the client’s legal interests.
