Good day! The most common misconception I've seen about trademark infringement is that it doesn't apply to small businesses, but only large corporations or well-known brands. As such small businesses or even startups are under the impression that securing their trademarks aren't as significant initially when they are first in the stage of things and are hence prone to lawsuits. Trademark infringement can occur at any level, and the financial and reputational consequences can be devastating. For instance, a young business may unknowingly borrow a name or design too close to a well-established brand, triggering expensive lawsuits or the expensive, and often brand-damaging, forced renaming of their companies. This misconception is damaging, as it places critical legal protections on hold for businesses that may require them to flourish and to maintain a presence in the market. Businesses of all sizes need to take timely action to analyze and register trademarks. This not only defends their brand name but also prevents any possible lawsuits which would harm their businesses. In my other life as a biomedical research advisor and co-founder of VMeDx, I have learned firsthand why protecting intellectual property including trademarks is so critical. I highly suggest that any businesses educate themselves on trademark laws and seek out an attorney on this.
